Terms of Service

These Terms of Service ("Terms") govern your access to and use of Luster CRM, operated by Scrapelocal Technologies (OPC) Private Limited ("Company", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Luster CRM, you confirm that you are at least 18 years old, have the authority to enter into these Terms (personally or on behalf of your business), and agree to be bound by them.

2. Description of Service

Luster CRM is a cloud-based business management platform for auto detailing businesses, providing tools for booking management, AMC subscription tracking, lead pipeline management, staff management, and reporting.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that provide inaccurate information or violate these Terms.

4. Subscription and Payment

Luster CRM offers a free plan and paid subscription plans. For paid plans:

• Subscriptions are billed monthly or annually as selected at purchase
• Payments are processed securely through Razorpay
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices are in Indian Rupees (INR) and inclusive of applicable taxes
• We reserve the right to change pricing with 30 days' advance notice

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Store or transmit malicious code or harmful content
• Attempt to gain unauthorised access to the Service or other accounts
• Resell or sublicense the Service without written permission
• Use the Service in a way that could damage, disable, or impair it
• Harvest or collect data about other users without their consent

6. Your Data

You retain ownership of all data you input into Luster CRM. By using the Service, you grant us a limited licence to process your data solely to provide the Service. We will not access your business data except to provide support when specifically requested by you, or as required by law.

7. Intellectual Property

The Service, including its design, code, features, and content (excluding your data), is owned by Scrapelocal Technologies (OPC) Private Limited and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

8. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.

9. Service Availability

We aim to maintain 99% uptime but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, upgrades, or security purposes. We will endeavour to provide advance notice for planned maintenance.

10. Termination

You may cancel your account at any time through your account settings. We may terminate or suspend your account immediately if you breach these Terms. Upon termination, you may export your data within 30 days before it is deleted from our systems.

11. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Thane, India.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
